Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the NevoMD platform and related services (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
NevoMD is provided exclusively for use by licensed physicians and authorized clinical professionals. The Service is intended as a clinical decision-support and physician co-pilot tool and is not intended to diagnose, treat, cure, or prevent any disease.
1. Eligibility and authorized use
You represent and warrant that you are a licensed healthcare professional or are otherwise authorized to use the Service. You agree to use the Service only for lawful purposes and in accordance with these Terms.
2. Account registration and security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify NevoMD promptly of any unauthorized access or use.
3. Clinical decision-support disclaimer
The Service provides informational and analytical outputs intended to support clinical decision-making. NevoMD does not provide medical diagnoses or medical advice. All clinical decisions remain the sole responsibility of the treating physician or healthcare professional.
4. Patient data and user responsibilities
You are solely responsible for any patient-related information or content you submit to the Service. You represent that you have obtained all necessary rights, consents, and authorizations to submit such information and to use the Service in compliance with applicable laws and professional obligations.
5. Subscriptions, billing, and payment
Certain features of the Service require a paid subscription. Subscription fees, billing cycles, and cancellation terms are described on the subscription page and are incorporated by reference into these Terms. Payments are processed by a third-party payment processor. NevoMD does not store payment card information.
6. Free trials and usage limits
NevoMD may offer free trials or usage-limited access at its discretion. Trial eligibility, limits, and duration may change at any time. Upon expiration or exhaustion of a trial, continued access requires an active paid subscription.
7. Intellectual property
The Service, including its software, design, text, graphics, logos, and content, is owned by or licensed to NevoMD and is protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service.
8. Acceptable use
You agree not to misuse the Service, including by attempting to access it without authorization, interfere with its operation, reverse engineer its components, or use it in violation of applicable laws.
9. Suspension and termination
NevoMD may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, or if required by law. Upon termination, your right to access the Service will cease.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, NevoMD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
12. Indemnification
You agree to indemnify and hold harmless NevoMD from any claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.
13. Governing law
These Terms are governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to conflict-of-law principles.
14. Changes to these Terms
NevoMD may modify these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
